i just wrote a paper on the alien and sedition acts and thomas jefferson and james madison opposed them not as a federalist abuse of censorship power (the sedition act) but as risking transferring authority over non-citizen persons from states to the federal government, to include aliens but also slaves (the alien act). the threat was that if the federal government had national jurisdiction they could nationally mandate abolition of slavery. jefferson was //so against this// that he outlined a legal argument allowing dissolution of the union should opposition to the acts not get them repealed. thankfully, i guess, adams was such a cock that his administration’s abuse of the sedition act to only target their political rivals turned puboic opinion and the historical record.
the tldr of this is that thomas jefferson in 1798 worked out a state’s rights based legal justification for the secession of the confederacy, and if adams had been just a little more popular, the civil war might have happened sixty years earlier.
also, washington was pissing himself about an illuminati led french conspiracy to undermine the us and steal the colonies, hence his vociferous support for the alien and sedition acts.
