F+W Media Files for Bankruptcy

I received notification F+W Media’s Chapter 11 bankruptcy in the mail yesterday.

This is quite a massive shock, as I had thought all was well with my publisher. I had just wrapped up a new how-to book with them in November and everyone was very optimistic about the title (I suspect my editor and the rest of the team were also in the dark about this).

Having been counting on receiving the 2nd half of the advance for my book this month, as well as July-December 2018 royalties, this is extremely bad news.

What does this bankruptcy notice mean for F+W authors like me? This is new territory for me, so I’m not sure what will happen in regards to payments due, royalties, rights, etc. Could our books be included in liquidation and sold to a third party? I don’t know. I’m not even sure what this means for the publication of my upcoming book later in the year.

I found an article on Forbes regarding the bankruptcy. While it doesn’t provide any answers for authors, it does provide information on how this all happened.

This article from the Craft Industry Alliance is also insightful.

Doing a bit of research, my understanding is that contributors and authors like myself are considered “unsecured creditors” in the event of a bankruptcy. Unsecured creditors receive a share of assets from the liquidation of a company in equivalence to the size of their debt, only AFTER secured creditors and preferential creditors have been paid. What this means is, we’re not guaranteed to be repaid the full amount owed (or even ANY of it).

Not good, not good at all, especially for us authors that depend on these royalty checks for our livelihood…

In conclusion, I think the next step for any affected author is to contact an attorney to help navigate the confusing world of legal forms and claims, which I will be looking into, though I am not sure how much good it will do.

Quick follow-up to this, and it’s all good news! :)

I’m pleased to report that all back owed royalties were paid, and my how-to books now have a new home at Penguin Random House through their newly acquired F+W imprint!
