true, these things do exist in some states, but in many states, the background checks that are conducted aren’t very secure and thoroughly done.

Federal background checks are already done in every state in the US on every gun legally sold by dealers and the background checks are done through the NICS system of the FBI. This has been the case since 1993 under the Brady Act.

Can you explain what issue you take with the NICS system? or did you just not know that was already the law?

Okay but….. my husband was able to purchase a gun for me, while I was in the store with him. They only checked him and not me. And it was obvious that the gun was for me.

I think the argument should be that all people involved in a purchase should be checked, not just the person making the purchase.

….so you did a straw purchase?

I honestly wouldn’t admit to that online. That’s super illegal.  

Like ten year prison sentence and $250K fine illegal.

It is and it isn’t, you are 100% legally allowed to give your wife a gun that you have bought as a gift. A straw purchase would mean buying the gun for someone else with their money because they could not buy it on their own. It’s on the NRA’s website.

Ok and why should I trust that? The 4473 is very clear in its question: Am I the actual transferee/buyer? Assuming we mean the same NRA article it states the exact opposite of the legal answer.

If you answer “yes” to this question, the sale cannot proceed. If you answer “no,” you are stating under penalty of law that you are not buying the firearm for someone else, other than as a bona fide gift.

It proceeds only with “yes”, that you are indeed the true transferee. And if we’re talking about this article where it says

If you, the buyer, are buying the firearm with your own money, not at the request of the other person, with the intention of giving the gun as a gift – you are the buyer.

Are we sure? Are we sure that’s the law? Because the ATF sets the rules, not the NRA.

You put far too much faith in the ATF's power, this is a common occurrence. The only time I've ever even heard of a straw purchaser being sentenced is after a local woman bought her boyfriend (multiple felonies) a gun which he then used in a quad homicide. She got less then a year for that.
