A/N: It's been a while for these two, if you haven't reread the first two chapters, I would recommend doing that because there are a lot of small details that you may have forgotten- but alas, if not, you are fine! I didn't realize how much I missed writing these two, life is handing me lemons right now, so I made LEMONADE. A special thank you to @txemrn for pre-reading one of the scenes. My sleep has been restless for the last few nights. I have not seen Sam since our strangely intimate moment during my first night here, the twins have tried to keep me entertained and distracted during the day, and for some fucked up reason, it worked. But at night… that was a different story entirely, it was like I was under his spell, all alone with my devilish thoughts. I lay tangled in luxurious satin sheets in a bed that was too soft, staring at the city slowly waking up through windows that were too big. My mind raced in the deafening silence as I cursed my traitorous body for melting into his rough touch. Every single thing about Sam Dalton has my body thrumming. He oozed sex appeal. It seemed to seep from every pore, perfuming the air around him. I didn’t realize how dangerous being in such close proximity would be for me, surrounded by his scent. I knew he had an unexplained effect on me at the bar, but now it was spiraling out of control. When he slipped his hand around my bare neck, I felt the electric shock down to my fucking toes.

The statutory framework for fair use is laid out in Section 107 of the Copyright Act. Courts will look at how the party (writer or artists) is using the copyrighted work. Noncommercial and nonprofit educational usage is more likely to pass the fair use test.

So an artist being paid for their time to create a fanart of copyrighted characters would in most circumstances fall under fair use as a no commercial usage. Likewise, a writer being paid for their time to create a fanfic of copyrighted characters would in most circumstances fall under fair use for the same reason.

The challenge in navigating the law comes into play when fanwork is monetized for commercial gain. A freelancer paid for their time by a private individual for fanwork is in most cases fair use. When that freelancer creates fanwork and charges a fee to view said work is when fair use law becomes murky.

These creations can still be consider fair use under the law if the freelancer has changed the purpose, view, and intent at the heart of the original copyrighted work beyond what the copyright holder intended. So a fanfic that no longer resembles the original, while still based on a copyrighted original, would be consider fair use if that change can be proven in court.

Additionally, one would have to prove that the original copyright holders economic gain and future market outlook is not drastically influenced to their detriment by said fanwork.

For both writers and artists it is best to charge for your time and not the completed work itself. Using tumblr+ for your fanwork posts will most likely be seen as charging for the finished work which can lead you into trouble with legal teams far beyond your means of challenging. This is true even if your creation could be argued fair use. Appearances play a large part in copyright law when fair usage comes into play.

However, this is the beauty of organizations like AO3 which provides authors and artists legal safety for their fanwork.

As someone that is married with two kids- I can tell you that is largely what is on my husbands mind most of the time as well. It’s funny though- because he (Sam) is supposed to be this high powered businessman and father and you would think he would have a little more solid head on his shoulders and be able to think logically and well under pressure.

He is kind of filling his void of problems and distracting himself with sex.

Actually more normal for a man than I think most might realize 🤷🏻‍♀️

Ok- I am going to do a thing. I’ve missed making social edit posts but cannot commit to smiles again (at least not right now) SO I am going to do social edits and maybe bonus ficlets or rewrites of scenes from the third book of TNA!

Each chapter I will release a new social edit that corresponds with the chapter, so something my MC (Ana) would have shared on her IG during that chapter. (Does that make sense??)

Obviously they won’t be in line with my actual Ana and Sam head canon, but same MC different universe.

Yay! First one will be up soon from yesterdays chapter.

Y’all happy TNA day. I’m losing my mind about Addison and my poor boys. And Sam’s lack of ability to actually be a grown adult FATHER. You need your fiancée who is at least 6 years younger than you to give you advice? Truthfully I know if you are in the middle of shit, sometimes it helps to talk it out with the one you love, but this is HUGE and I think you should have something more to say than… I froze.
