I think this is overdue a proper announcement!

If you're unaware, I'm one of the members of the New XKit team. It's no secret though that New XKit is kinda dead in the water, thanks to Tumblr's overhaul of its interface which broke almost every feature we had. Oh, and everyone else on the team has a day job now, so I decided to take matters into my own hands:

XKit Rewritten is the result of my work of over a year, now available for Firefox and Chrome (and by extension, Edge and Opera too). There are still features to be added, but the featureset has now mostly overtaken the current working featureset of XKit 7.

If you're already an XKit user, I heartily recommend trying the new experience - even if it means configuring everything again - for its improved performance and increased compatibility.

If you're not already an XKit user, I invite you to give it a go! There's probably some option you'll enjoy. Even if you're on your phone all the time, there's a janky way to set it up on Firefox for Android (sorry, iOS users; blame Apple, not me) which I've also detailed on the wiki.

For anyone who might be writing fic in order to raise money/donations for a cause, please remember not to mention that anywhere on AO3. It is against the Terms of Service to charge money for fic, even if that money is not going to you, personally. Please don’t mention commissions or donations or fundraising or patreon or kofi etc etc in a fic or on your profile. ❤

I will boost this signal, mostly for myself because my brain is apparently a fucking colander and I can’t remember shit sometimes; and also add, if you’re the one who commissioned a fic, don’t mention that on ao3 either. Not even in your bookmarks! I forget other people can see my notes there. Please don’t get your writing friends in trouble, like I almost did a couple of times :( 

Just say ‘i asked for this pairing/trope/continuation/whatever’ Don’t say ‘i commissioned this’.

i’ve had “if you enjoy my writing, click here” with a link to my kofi in all of my end notes for a couple years and nothing’s happened, so maybe try that

Nope. You’re still breaking their TOS by having a site like ko-fi directly linked, and if anyone finds that out or someone reports you, you can lose your entire account. They have to enforce these rules in order to protect us from copyright laws. It’s why for decades individual fandom creators used to put “I do not own this work or profit from it” at the start of every fic/chapter.

What you can do, is say “follow me on tumblr” and promote your ko-fi on your tumblr. But I’ve seen people do the link to their ko-fi/patreon without explicitly mentioning them and still losing their accounts or getting hit by warnings cause someone reported them. (The one person I knew who outright lost their account just kept doing it repeatedly despite multiple warnings, like a doofus, so that was on them.)

(I think there may be exceptions for certain charity drives, but I don’t think ko-fi and patreon are protected by that)

Hi! Former AO3 Abuse team member here! It’s been a bit, so I’ll admit that my knowledge may be slightly out of date. But generally speaking you cannot:

Link Directly to:

  • Kofi
  • Patreon
  • Amazon
  • Your private book site where you sell your writing
  • Any other fundraising site such as gofundme etc

If you link and are reported your work is in danger of being deleted, but you will be given a warning and time to fix any issues.

You also cannot mention that a work was directly commissioned with $$, hide the rest of your work/novel/chapter/ or in any way paywall the remainder of your work. Things like “support my writing here!!” are usually no go.

General phrasings like trade, requested, asked for, etc are OK.

Joy is correct in saying linking to your tumblr which advertises your kofi or fundraiser is ok.

If you are reported, the AO3 team will do their best to let you know EXACTLY what works and what phrasing is not allowed. They do issue a blanket “responsible for the rest of your works” statement so be thorough.

AO3 WILL NOT DELETE YOUR WORK, BAN YOU, OR IN ANY WAY REMOVE ITEMS WITHOUT WARNING. IF YOUR WORK IS DELETED YOU WILL RECEIVE AN EMAIL CONTAINING THE DELETED WORK. KEEP YOUR EMAIL ADDRESS CURRENT. NEVER USE A STUDENT EMAIL ACCOUNT.

Woodsign fanfic app on the App Store

Lots of people have been pinging me in posts about this company and their various apps (pictured above). I don’t own any Apple products, so I haven’t been able to see these apps myself, but my understanding is that they pull data from AO3 and present it in the app, sometimes for a fee. 

If you’re wondering whether your own stories are being hosted on these apps, you’ll need to either check for yourself or find a friend who can check for you.

I emailed AO3 Support about the subject, and here’s what I got in response:

Thanks for asking about this app. We checked with the OTW Legal team and our coders, and have some information to pass on. “The OTW does not own the works posted on the Archive – they are all owned by their respective authors. 
For that reason, although the OTW can (and does) rely on trademark law to make sure that people don’t make confusing apps that would make people think the OTW or AO3 is associated with them, there’s nothing we can do about apps or services that contain works owned by AO3 users.  That is up to the authors themselves, who own the copyrights in their fanworks. 
“Many sites have procedures (known as DMCA takedown procedures) that allow copyright owners such as fan-authors to request that their works be removed. The app in question may have such procedures.   Regardless of whether those procedures exist, copyright owners can always demand that their works be removed from places they are not authorized, and as a matter of copyright law, sites should comply with such demands.
“The Apple App store also has procedures for reporting apps that infringe copyright:  https://www.apple.com/legal/internet-services/itunes/appstorenotices/#?lang=en 
“The Google Play store has similar: https://support.google.com/legal/troubleshooter/1114905 
"To be clear, to the best of our knowledge, the app is not wholesale scraping and storing data - they’re displaying content from the Archive in a very heavily modified format. Because the app’s subscription fee can be explained as "to support the app’s code base” and not for the content itself, it is within legal bounds. Our only suggestions are for the creators of the works to issue DCMA takedowns to the app developer, and to the appropriate app store if they find the developer response unsatisfactory.

tldr; There’s nothing that AO3 can do in this situation. It’s up to individual authors to report the copyright infringement to protect their own work. Start with the app itself and then go to the app store if they don’t do as you requested. 

If you could signal boost this post, I’m sure AO3 Support would appreciate it. I can only imagine how many emails they’re getting about this right now.
